Is Permission Required?

Advice on planning permission is available on the Government's website Planning Portal - Permission and it provides a very useful interactive guide for householders requiring advice on the need for planning permission for a proposal.

Informal Advice Service on whether Planning Permission is required

You may apply to the Council for an informal opinion on whether planning permission is required although it is not possible to confirm definitively that a proposal does not need permission. As of 1st August 2016 there is, for certain types of development, a charge for this service.

Fees and Charges.

The Council has been reviewing the fees charged for pre-application advice, following their introduction last year.

We have been advised that the service is VAT-chargeable and for year one, the Council absorbed the Vat cost within the pre-application charge.  However, from 26th June 2017, VAT will be charged on these fees. However, we have also identified some service improvements in some areas which will involve charges being reduced in some cases.  These are as follows:

  • For commercial changes of use, a new category has been introduced to make this fee consistent across all sizes - previously the charge for larger-scale changes of use was disproportionate to the planning application fee.
  • For  Parish Councils and Registered Charities we've decided to charge only half the normal fee, where the proposal is for community benefit
  • We've clarified that no fee will be charged for proposals for the benefit of a registered disabled person
  • We've also clarified that where both planning and listed building advice is sought simultaneously, only the higher of the two fees is charged (and not both)

These changes will be introduced from 3rd July 2017. Any applications validly received before that date will be charged under the previous arrangements

If you would like advice on whether permission is needed, please complete the form below and return to us together with the relevant fee (where applicable) and a plan identifying the location and extent of the site. 

Upon receipt of the completed form, we will provide you with:

  • An acknowledgement of the request with the assigned case officer's details within seven days
  • A written response within 28 days

Details are available here: Pre Application Advice   Should you wish to seek advice both on the need for permission for your scheme and the likelihood of gaining planning consent, you need only apply for pre-application advice (i.e. not both separately).
